These Terms of Use ("Terms") govern your access to and use of the Mimic mobile application and the website at mimicparenting.com (together, the "Service"), provided by Mimic Labs LLC ("Mimic," "we," "us," or "our"). By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using Mimic, you represent that you meet this requirement and that you are using the Service for your own personal practice as a parent or guardian.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at hello@mimicparenting.com if you believe your account has been compromised.
Subject to these Terms, Mimic grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use. You may not: (a) reverse-engineer, decompile, or otherwise attempt to derive source code from the app; (b) use the Service to build a competing product; (c) resell, sublicense, or redistribute the Service; (d) remove proprietary notices; (e) use the Service in violation of law.
Mimic offers monthly and annual auto-renewing subscriptions, and a one-time lifetime purchase, sold through the Apple App Store. Pricing is shown in the app at the time of purchase.
New subscribers may be offered a 7-day free trial. If you do not cancel before the trial ends, your subscription will begin automatically and you will be charged the applicable subscription fee. You can cancel at any time during the trial in your Apple ID settings.
Auto-renewing subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the renewal date. Renewal charges are made to your Apple ID account.
You can cancel your subscription at any time by going to Settings → [your name] → Subscriptions on your iOS device, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period.
Refunds for App Store purchases are handled by Apple under Apple's refund policy, not by Mimic. To request a refund, visit reportaproblem.apple.com.
The Service lets you record photos, videos, text, habits, vices, and other content (your "Content"). You retain all rights in your Content. You grant Mimic a limited, worldwide, royalty-free license to host, store, and display your Content solely for the purpose of providing the Service to you.
You are solely responsible for your Content. You represent that you have the rights necessary to upload it (including, where applicable, the rights to upload images of others) and that your Content does not violate any law or third-party right.

Mimic supports a personal practice; it is not a substitute for professional advice. The Service does not provide medical, psychological, psychiatric, therapeutic, or legal advice, and is not intended to diagnose, treat, cure, or prevent any condition. If you are struggling — with addiction, mental health, parenting crises, or anything else — please reach out to a qualified professional. In an emergency, contact your local emergency services.
Mimic, the Mimic name, the eye logo, and all related designs, software, and content provided by us are owned by Mimic Labs LLC and protected by intellectual property law. These Terms grant you no rights in our trademarks or branding.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and dispute terms) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIMIC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MIMIC IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability for fraud, gross negligence, or anything that cannot be limited by law.
You agree to indemnify and hold harmless Mimic from claims, damages, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) your Content, or (c) your violation of any law or third-party right.
The following terms apply to your use of the Mimic iOS app, in addition to the rest of these Terms:
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Illinois, and you consent to personal jurisdiction there. If you are a consumer in the EU, UK, or another jurisdiction with mandatory consumer-protection rules, those rules continue to apply to you regardless of this section.
We may update these Terms from time to time. If we make material changes, we will notify you (by email or in-app) before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
